Y\u00f6netmelik kapsam\u0131nda y\u0131k\u0131m plan\u0131n ger\u00e7ekle\u015ftirilmesi, y\u0131k\u0131m ruhsat\u0131n\u0131n al\u0131nmas\u0131, y\u0131k\u0131m faaliyeti ve at\u0131k y\u00f6netimi hakk\u0131nda d\u00fczenlemeler getirilmi\u015ftir. S\u00f6z konusu Y\u00f6netmelik h\u00fck\u00fcmleri ise 01.07.2022 tarihinden itibaren y\u00fcr\u00fcrl\u00fckte olacakt\u0131r.<\/p>\n<p><strong>Binalar\u0131n Y\u0131k\u0131m\u0131<\/strong><\/p>\n<p>Y\u00f6netmelik kapsam\u0131nda binalar\u0131n y\u0131k\u0131m\u0131na ili\u015fkin bina y\u00fcksekli\u011fi 21.50 m ve daha fazla olan binalar i\u00e7in fenni mesuliyetin in\u015faat m\u00fchendisi stat\u00fcs\u00fcn\u00fc haiz ki\u015filer taraf\u0131ndan \u00fcstlenilece\u011fi d\u00fczenlenmi\u015ftir. 21.50 m s\u0131n\u0131r\u0131n\u0131n alt\u0131ndaki binalar i\u00e7in fenni mesuliyet \u015fart\u0131 aranmamaktad\u0131r. Ancak patlay\u0131c\u0131larla yap\u0131lan y\u0131k\u0131m faaliyeti ile ikiden fazla bodrum kat\u0131 olan her t\u00fcrl\u00fc binan\u0131n y\u0131k\u0131m\u0131nda fenni mesuliyet zorunludur. Binalar ancak Yap\u0131 M\u00fcteahhitlerinin S\u0131n\u0131fland\u0131r\u0131lmas\u0131 ve Kay\u0131tlar\u0131n\u0131n Tutulmas\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fe g\u00f6re yetki belge numaras\u0131n\u0131 alm\u0131\u015f ve uygun s\u0131n\u0131fta yeterlili\u011fe sahip ger\u00e7ek veya t\u00fczel ki\u015fili\u011fi bulunan bir m\u00fcteahhidin sorumlulu\u011fu kapsam\u0131nda y\u0131k\u0131labilir. Y\u00f6netmelik kapsam\u0131nda m\u00fcteahhit taraf\u0131ndan istihdam edilen \u015fantiye \u015fefinin de y\u0131k\u0131m s\u00fcrecinde bulundurulmas\u0131 gerekmektedir.<\/p>\n<p><strong>Y\u0131k\u0131m Plan\u0131 <\/strong><\/p>\n<p>Y\u0131k\u0131m plan\u0131 m\u00fcellif taraf\u0131ndan haz\u0131rlan\u0131r ancak m\u00fcteahhidin m\u00fcellif \u015fartlar\u0131na sahip olmas\u0131 halinde m\u00fcteahhit de y\u0131k\u0131m plan\u0131 haz\u0131rlamaya yetkili k\u0131l\u0131nm\u0131\u015ft\u0131r. Y\u0131k\u0131m plan\u0131 ise;<\/p>\n<ul>\n<li>Y\u0131k\u0131mdan \u00f6nce kullan\u0131lacak y\u0131k\u0131m y\u00f6ntemi,<\/li>\n<li>Bina ve \u00e7evresinde etkilenebilecek yap\u0131, altyap\u0131, tesisat,<\/li>\n<li>Trafik ve insanlar\u0131n g\u00fcvenliklerinin sa\u011flanaca\u011f\u0131 tedbirler,<\/li>\n<li>Binan\u0131n \u00f6zellikleri ile ta\u015f\u0131y\u0131c\u0131 sistemi ve ta\u015f\u0131ma g\u00fcc\u00fc imkanlar\u0131 ile t\u00fcm risk unsurlar\u0131,<\/li>\n<li>At\u0131k y\u00f6netim plan\u0131 ve toz emisyonu kontrol\u00fc i\u00e7in al\u0131nmas\u0131 gereken tedbirler,<\/li>\n<li>Y\u0131k\u0131lacak binan\u0131n mimari ve\/veya statik projeleri(bulunuyorsa),<\/li>\n<\/ul>\n<p>tespit edilerek TS13633 Yap\u0131lar\u0131n Tam ve K\u0131smi Y\u0131k\u0131m\u0131 \u0130\u00e7in Uygulama Kurallar\u0131 Standard\u0131na uygun \u015fekilde haz\u0131rlan\u0131r. Ayr\u0131ca patlamal\u0131 y\u0131k\u0131mlarda s\u00f6z konusu belgelere ek olarak; y\u0131k\u0131m faaliyetleri s\u0131ras\u0131nda olu\u015facak g\u00fcr\u00fclt\u00fc ve titre\u015fimin kontrol\u00fc amac\u0131yla haz\u0131rlanan akustik rapor ve patlatma y\u00f6ntemi veya plan\u0131n\u0131 i\u00e7eren rapor da y\u0131k\u0131m plan\u0131na eklenmelidir.<\/p>\n<p>Y\u00f6netmelik ile bodrum kat\u0131 d\u0131\u015f\u0131nda en \u00e7ok bir katl\u0131, bina y\u00fcksekli\u011fi 6 metreyi ve yap\u0131 in\u015fa alan\u0131 250 m\u00b2\u2019yi ge\u00e7meyen m\u00fcstakil ve ayr\u0131k nizam yap\u0131lar\u0131 ile bir binada toplam alan\u0131 250 m\u00b2\u2019yi ve kat in\u015fa alan\u0131n\u0131n %10\u2019unu a\u015fmayan k\u0131smi y\u0131k\u0131mlarda y\u0131k\u0131m plan\u0131 d\u00fczenleme zorunlu\u011fu kald\u0131r\u0131larak istisnai bir h\u00fck\u00fcm getirilmi\u015ftir.<\/p>\n<p>Y\u0131k\u0131m\u0131 ger\u00e7ekle\u015ftirebilmek i\u00e7in Y\u00f6netmelik\u2019 e uygun olarak haz\u0131rlanan y\u0131k\u0131m plan\u0131n\u0131 ilgili idareye ibraz ederek y\u0131k\u0131m ruhsat\u0131 d\u00fczenlenmesi amac\u0131yla ba\u015fvuru yap\u0131lmal\u0131d\u0131r.<\/p>\n<p>Ayr\u0131ca y\u0131k\u0131m\u0131n herhangi bir k\u00fclt\u00fcr veya tabiat varl\u0131\u011f\u0131n\u0131n etkile\u015fim ve ge\u00e7i\u015f sahas\u0131 i\u00e7inde yer alan bir yap\u0131y\u0131 kapsamas\u0131 durumunda, y\u0131k\u0131ma ba\u015flamandan \u00f6nce Korumu Kurulu\u2019ndan uygun g\u00f6r\u00fc\u015f al\u0131nmal\u0131d\u0131r.<\/p>\n<p><strong>Y\u0131k\u0131m S\u00fcreci <\/strong><\/p>\n<p>Y\u00f6netmelik h\u00fck\u00fcmleriyle y\u0131k\u0131m s\u00fcreci ger\u00e7ekle\u015ftirilirken m\u00fcteahhit ve fenni mesul taraf\u0131ndan yerine getirilmesi gereken y\u00fck\u00fcml\u00fcklere dair \u00f6zel d\u00fczenlemeler getirilmi\u015ftir.<\/p>\n<ul>\n<li>Y\u00f6netmelik kapsam\u0131nda ilgili m\u00fcteahhit y\u0131k\u0131m faaliyetine ba\u015flamadan \u00f6nce g\u00fcvenlik ve \u00e7evre koruma tedbirlerini alarak y\u0131k\u0131m \u015fantiyesi kurmakla m\u00fckellef k\u0131l\u0131nm\u0131\u015ft\u0131r. Y\u0131k\u0131m \u015fantiyesinin ise risk de\u011ferlendirmesi sonucuna uygun olarak kurulmas\u0131 ve \u00e7al\u0131\u015fanlar ile \u00e7evre i\u00e7in \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcme riayet edilerek olu\u015fturulmas\u0131 gerekmektedir.<\/li>\n<li>M\u00fcteahhit, y\u0131k\u0131m s\u00fcrecinde ve sonras\u0131nda \u00e7al\u0131\u015fanlar ve \u00fc\u00e7\u00fcnc\u00fc ki\u015filer i\u00e7in ilgili mevzuatta \u00f6ng\u00f6r\u00fclen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirmelidir.<\/li>\n<li>Y\u00f6netmelik kapsam\u0131nda fenni mesul taraf\u0131ndan y\u0131k\u0131m s\u00fcrecinin, y\u0131k\u0131m plan\u0131 ve y\u0131k\u0131m ruhsat\u0131na ayk\u0131r\u0131 y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcn\u00fcn tespiti halinde ilgili idareye ba\u015fvurma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. \u0130lgili idare taraf\u0131ndan herhangi bir ayk\u0131r\u0131l\u0131\u011f\u0131n tespiti neticesinde de y\u0131k\u0131m faaliyetlerinin eksikli\u011fin giderilmesi an\u0131na kadar durdurulaca\u011f\u0131 d\u00fczenlenmi\u015ftir.<\/li>\n<li>Binalar\u0131n y\u0131k\u0131m\u0131nda TS13633 standard\u0131nda yer alan y\u0131k\u0131m tekniklerinden herhangi biri kullan\u0131labilir. Ancak biti\u015fik nizam yap\u0131la\u015fmalar\u0131nda y\u0131k\u0131m\u0131n kom\u015fu binaya zarar verece\u011fi durumda elle y\u0131k\u0131m tekni\u011finin uygulanmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/li>\n<li>Y\u0131k\u0131m\u0131n ard\u0131ndan en ge\u00e7 otuz g\u00fcn i\u00e7inde yanan ve y\u0131k\u0131lan yap\u0131lar formu olu\u015fturularak fenni mesul\u00fcn kay\u0131tl\u0131 oldu\u011fu ilin \u00c7evre ve \u015eehircilik \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile ilgili meslek odas\u0131na ibraz edilmelidir.<\/li>\n<\/ul>\n<p><strong>Y\u0131k\u0131m S\u00fcrecinde \u00c7evre ve At\u0131k Y\u00f6netimi<\/strong><\/p>\n<p>Y\u00f6netmelik kapsam\u0131nda; y\u0131k\u0131m faaliyetlerini ger\u00e7ekle\u015ftiren m\u00fcteahhit, y\u0131k\u0131m s\u00fcrecinde meydana gelen at\u0131klar\u0131n \u00e7evreye zarar vermesini engellemek amac\u0131yla at\u0131klar\u0131n \u00e7evre ve sa\u011fl\u0131k \u015fartlar\u0131na uygun hale getirmekle sorumlu k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n<ul>\n<li>M\u00fcteahhit; y\u0131k\u0131m s\u0131ras\u0131nda ortaya \u00e7\u0131kacak her t\u00fcrl\u00fc at\u0131\u011f\u0131n kayna\u011f\u0131nda uygun proseslere ayr\u0131lmas\u0131, ge\u00e7ici biriktirmesini sa\u011flamakla ve \u00e7evre ve insan sa\u011fl\u0131\u011f\u0131n\u0131 g\u00f6zeterek at\u0131k y\u00f6netimini sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n<li>Y\u00f6netmelik ile y\u0131k\u0131m s\u00fcrecinde olu\u015fan at\u0131klar\u0131n ge\u00e7ici bir s\u00fcre olsa dahi akarsu yataklar\u0131n\u0131n doldurulmas\u0131na veya bunlar\u0131m y\u00f6n\u00fcn\u00fc de\u011fi\u015ftirmesine yol a\u00e7acak nitelikte biriktirme i\u015flemi yasaklanm\u0131\u015ft\u0131r.<\/li>\n<li>Asbest t\u00fcr tayini parametresinden yetkilendirilmi\u015f bir laboratuvar taraf\u0131ndan asbest ve di\u011fer tehlikeli maddelerin tespiti yapt\u0131r\u0131lmal\u0131d\u0131r. Ayr\u0131 olarak toplanan s\u00f6z konusu imalatlar, y\u0131k\u0131m faaliyetine ba\u015flan\u0131lmadan s\u00f6k\u00fclerek toplanmal\u0131d\u0131r. \u0130malatlar topland\u0131ktan sonra At\u0131klar\u0131n D\u00fczenli Depolanmas\u0131na Dair Y\u00f6netmelik uyar\u0131nca bertaraf edilerek s\u00f6z konusu y\u00fck\u00fcml\u00fcl\u00fck yerine getirilecektir.<\/li>\n<li>Toz emisyonunun \u00e7evreye verece\u011fi zarar\u0131 engellemek amac\u0131yla TS13833 standartlar\u0131na uygun olarak toz bast\u0131rma sistemi kullan\u0131lmas\u0131 zorunludur.<\/li>\n<li>Patlamal\u0131 y\u0131k\u0131mlarla s\u0131n\u0131rl\u0131 olmak \u00fczere g\u00fcr\u00fclt\u00fc ve titre\u015fimin kontrol\u00fc amac\u0131yla akustik rapor al\u0131narak rapor kapsam\u0131nda \u00e7al\u0131\u015fanlar\u0131n maruz kalaca\u011f\u0131 riskleri bertaraf etmek amac\u0131yla sa\u011fl\u0131k ve g\u00fcvenlik tedbirleri al\u0131nmal\u0131d\u0131r.<\/li>\n<\/ul>\n<p><strong>Sonu\u00e7<\/strong><\/p>\n<p>S\u00f6z konusu Y\u00f6netmelik 2872 say\u0131l\u0131 \u00c7evre Kanunu (\u201c<strong>\u00c7evre Kanunu<\/strong>\u201d) ve 3194 say\u0131l\u0131 \u0130mar Kanunu(\u201c<strong>\u0130mar Kanunu<\/strong>\u201d) kapsam\u0131nda haz\u0131rlanm\u0131\u015ft\u0131r. Y\u00f6netmelik kapsam\u0131nda binalarda y\u0131k\u0131m yapmak isteyen ger\u00e7ek ve t\u00fczel ki\u015filer i\u00e7in \u00f6zellikle y\u0131k\u0131m plan\u0131, y\u0131k\u0131m ruhsat\u0131, y\u0131k\u0131m faaliyeti ve at\u0131k y\u00f6netimi konusunda \u00f6zel y\u00fck\u00fcml\u00fcl\u00fckler \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.
