Chairman Decisions of Information Technologies and Communication Authority Regarding the Prohibition of Advertisement to Social Network Providers who Fail to Fulfill the Obligation to Appoint and Report a Representative

It was decided to ban advertisements to some social network providers who did not fulfill the obligation to appoint and report a representative with the chairman decisions of the Information Technologies and Communication Authority (“Authority”) published in the Official Gazette dated 19.01.2021.

In this context, the obligation to designate at least one person as representative for foreign sourced social network providers who has more than one million access daily from Turkey is emphasized in accordance with additional article 4 of Law No. 5651 on Regulating Broadcasts Made on the Internet and Combating Crimes Committed Through These Publications (“Law”)

It was pointed out that chairman shall ban taxpayer natural and legal persons resident in Turkey to give advertisement to social network providers in the event that the related social network provider has not fulfilled its obligation in question after it has been notified twice in accordance with the second paragraph of additional Article 4 of Law.

In this context, it was decided to ban new advertisements for Pinterest Inc., Twitter Inc. and Periscope/Scope within the body of Twitter Inc. who have more than one million access daily from Turkey, with the chairman decisions published in the Official Gazette dated 19.01.2021.
